Could Taylor Swift’s Prenup With Travis Kelce Affect Future Songs and Masters?

Taylor Swift and Travis Kelce’s reported prenup negotiations are now raising questions that go beyond money and property — including how the agreement could affect Swift’s music moving forward.

According to Page Six, lawyers familiar with high-profile celebrity marriages say the document could include confidentiality clauses that would prevent Swift and Kelce from publicly discussing their marriage. But one area may remain untouched: Swift’s songwriting.

Sarah Luetto, a partner in Blank Rome’s Matrimonial & Family Law Group, said that while privacy provisions are common in celebrity prenups, Swift would likely carve out exceptions tied to her work as a songwriter.

“In Taylor’s case, she would likely not want to include provisions limiting her from singing about her relationship in songs,” Luetto explained, noting the intense public focus surrounding the inspirations behind Swift’s music.

Swift’s catalog has long been tied to autobiographical storytelling. Her recent albums have included references to past relationships, and reports claim 2025’s The Life of a Showgirl also included material inspired by Kelce.

Luetto also suggested that the agreement could address how future recordings are treated legally during the marriage. “If Taylor had re-recorded one of her albums during marriage, there would be an argument that the re-record was partially a marital asset,” she said.

That issue carries added weight given Swift’s years-long effort to regain control of her masters and re-record earlier projects under her ownership.

The latest developments build on earlier reports that Swift and Kelce are preparing for a summer wedding, potentially in New York City, after earlier plans reportedly centered on Rhode Island.

Reports in recent weeks have also suggested the couple has been evaluating which state would provide the strongest legal framework for a prenup, with Rhode Island and Kansas emerging as possibilities due to more favorable enforcement laws. California has reportedly already been ruled out.

Privacy appears to be a major focus throughout the reported negotiations. Luetto said agreements involving celebrities at Swift and Kelce’s level often include non-disclosure provisions, mediation requirements, and even private judges for potential disputes in order to keep proceedings out of public view.

At the same time, reports suggest the couple would likely maintain separate estates despite potentially entering joint business ventures together during the marriage.

Neither Swift nor Kelce has publicly commented on the reported prenup discussions.
