In denying claims by Lil Baby-owned company The Holding Co., hemp brand Bay Smokes has followed through on its earlier promise and countersued with allegations of a violated non-disclosure agreement.
In April, The Holding Co. sued the Florida-based Bay Smokes over Lil Baby-branded hemp products “WHAM!”, “SAVAGE PATCH!” and “GOON BERRIES!” which allegedly contained illegal cannabis products, and “failed microbial safety testing and contained over 22% of total THC” along with E. coli. Additionally, Holding Co. claimed that Bay Smokes, co-founded by adult entertainer Katiana Kay and William James Goodall, posted erotic videos that could potentially be aligned with Lil Baby’s trademark.
Bay Smokes later shared a statement standing by their products and claiming that the company thoroughly undergoes “independent third-party laboratory testing.”
In court documents filed on Thursday, July 11, and read by Complex, Bay Smokes has accused The Holding Co. of violating a confidentiality and non-disclosure agreement in their partnership. The brand also points to Holding Co. principal, Eric Anderson, claiming that he “disparaged” the company and their licensed products at industry trade shows, and directed customers to competitors. Bay Smokes told Complex back in April that they were planning on pursuing counterclaims.
Bay Smokes now alleges that they have suffered injuries and are entitled to monetary damages and a repayment of legal fees.
Bay Smokes and Holding Co. established a partnership in 2024 with the WHAM line, which preceded the January 2025 release of Lil Baby’s fourth album of the same name.
