On Tuesday, it was reported that Nipsey Hussle's sister Samantha Smith has put plans in motion to gain guardianship of the rapper's eldest daughter. But Smith could be facing some opposition from the child's mother.
According to documents obtained by The Blast, Hussle and his ex-girlfriend Tanisha Foster were granted joint custody of their daughter Emani Asghedom in 2013. Per the documents, Hussle was given weekends with Emani while Foster took her during the week. Despite being Emani's legal primary guardian, Smith claims Hussle was the child's de facto caregiver as she spent the majority of her time with her father. Smith explains this is a result of Foster's inability to properly provide for Emani, which prompted her to seek custody following Hussle's murder.
In Smith's petition, she doesn't mention the 2013 ruling. As a result, Foster would have a strong legal case if she wanted to fight Smith for guardianship. As of now, Foster has reportedly not filed in opposition to Smith. If granted full custody, Foster would have a legal right to money collected from Nipsey's estate, and would have an official say in the way the business is conducted until Emani reaches of age.
