Sia’s estranged husband Daniel Bernad has reportedly requested sole custody of the couple's 1-year-old son, Somersault Wonder Bernad.
According to legal documents reviewed by TMZ, Bernad alleged that the 49-year-old “Chandelier” singer is a “serious and immediate” danger to the child.
"Sia is an unfit and unreliable parent struggling with substance abuse and addiction, rendering her incapable of providing safe or stable care for Summi,” Bernad said in the documents, per TMZ.
He argued that he is the “only safe and reliable parent” and requested that Sia undergo random drug testing and be limited to three, two-hour professionally monitored visits per week.
Sia countered that there is no emergency reason to alter custody, asserting that their son has remained safe under her care since the couple separated. She noted that back in August 2025, both parties agreed Bernad would have only restricted, monitored visits because of an ongoing Los Angeles Police Department and family services investigation into "illicit child pornography" allegedly found on his computer.
Sia said she demanded supervision after learning about the investigation, though Bernad has denied any wrongdoing and accused her of having "planted evidence" to limit his visitation.
Bernad also alleged that Sia concealed a recent two-week hospitalization during which she tested positive for barbiturates and benzodiazepines. He requested $77,245 per month in child support, claiming he has no current income because Sia "ceased all funding" for their joint venture, Modern Medicine.
Although he was once an oncologist, Bernad said he is now unemployed and fully financially dependent on Sia, whom he described as having an "extremely successful and long music career."
On the other hand, Sia maintained that she has been sober for over six months and continues to agree to drug testing but that Bernad has refused to do so regularly. She acknowledged her past substance abuse struggles from 15 years ago, adding that recovery has been a "cornerstone" of her life.
"Dan's attempt to weaponize my past sobriety journey ... serves no legitimate purpose and is intended only to distort the facts and undermine my credibility," she told the court.
Sia also said she was willing to expand Bernad's custodial time if supervised by a trusted caretaker, such as his mother or a nanny, but opposed any drastic changes to their current custody plan.
TMZ noted that Sia filed for divorce in March after two years of marriage, citing "irreconcilable differences" and requesting legal and physical custody of their son, while remaining open to visitation for Bernad.
This marks Sia's second divorce; she previously split from filmmaker Erik Lang in 2016.
According to Billboard, which reported on Bernad's spousal support filing dated Oct. 10, he claimed that he was owed more than $260,000 per month from Sia following their split.
In that filing, Bernad said he and Sia lived a "luxurious and upper-class lifestyle," spending more than $400,000 monthly on private jets, fine dining, and full-time staff.
