D4vd has been arrested in connection with the murder of Celeste Rivas Hernandez, the teen found dead in the trunk of a Tesla last September. The Withered artist’s legal team, however, is asserting his innocence in the case.

As first reported by TMZ, attorneys for David Burke, a.k.a. D4vd—including Blair Berk, Marilyn Bednarski, and Regina Peter—have argued that “the actual evidence” in the case will show that their client “did not murder” Rivas.

“Let us be clear: the actual evidence in this case will show that David Burke did not murder Celeste Rivas Hernandez and he was not the cause of her death,” the attorneys told Complex when reached for comment on Friday (April 18). “There has been no indictment returned by any grand jury in this case and no criminal complaint filed.”

The attorneys went on to note that D4vd “has only been detained under suspicion,” adding they will “vigorously defend David’s innocence.”

On Thursday (April 16), LAPD reps announced their arrest of D4vd, 21, who is being held without bail.

“The case will be presented to the District Attorney’s office on Monday for filing consideration,” a department spokesperson said.

Complex has reached out to LAPD reps for additional comment. This story may be updated.

The case extends back to September of last year, when LAPD reps confirmed that officers had responded to the 1000 block of Mansfield Avenue for what they described at the time as “a foul odor coming from a vehicle” at a tow yard in the area. Initially, detectives were revealed to have located “possible human remains” in the vehicle. The remains were later identified as Celeste Rivas Hernandez.

Also in September, per a statement shared with Complex at the time, detectives from LAPD’s Robbery-Homicide Division executed a search warrant at a residence in connection with the investigation, leading to the recovery of “several items of evidence,” though the nature of those items wasn’t immediately disclosed.
