A defendant in the Pooh Shiesty kidnapping case, the rap star’s alleged “right-hand man,” was let out on bond, only to have his victory pulled away with an appeal by prosecutors.
Kedarius Waters appeared in front of a magistrate judge in federal court in northern Texas on Monday (Apr. 27). The judge ruled that Waters, accused of playing a key part in the robbery and kidnapping of Gucci Mane and several others at a Dallas recording studio, could be let out on a personal recognizance bond, meaning he would be free (although subject to certain conditions) until trial.
However, just as with his co-defendants Big30 and Lontrell Williams Sr. (Pooh Shiesty’s father), the granting of the bond was delayed in order to give prosecutors time to appeal the decision — and just as in the other two cases, prosecutors took the judge up on the offer. All three defendants remain in jail pending the outcome of the respective appeals.
Prosecutors submitted a letter to the court after the hearing on Monday, saying that they were appealing the decision to let Waters go free. They cited “the seriousness of the defendant’s offense conduct, his criminal history, and the potential danger that the defendant poses to the community.” They went on to say that they will submit their written arguments as to why Waters should remain behind bars by May 5.
Waters, nicknamed “KD,” is described as Pooh Shiesty’s “right-hand man” in charging documents. He is accused of holding Gucci and the other men at gunpoint during the alleged robbery. He then allegedly went back to a hotel in Dallas with a number of the co-defendants.
Waters posted on Instagram on Tuesday, appearing to celebrate his 25th birthday from behind bars. His birth date is redacted in court records, so Complex could not immediately confirm it. However, his birth year of 2001 is visible.
“Physically I’m standing tall was taught don’t let em see me sweat!” he captioned a photo of what appeared to be him on the phone in jail. He hashtagged the post “#wishmeone #25🎂 #lldell.”
Pooh Shiesty and eight other men, including Waters, are accused of robbing Gucci and several others at a Dallas recording studio back in January, and of forcing Gucci at gunpoint to sign paperwork releasing Pooh from his contract with 1017 Records.
