Nick Carter is being accused of sexually assaulting a woman who claims he gave her sexually transmitted diseases.
According to the lawsuit as reviewed by TMZ, a woman named Laura Penly claims she met the Backstreet Boys singer in 2004 when she was 19 years old and began a sexual relationship for several weeks in Los Angeles.
Penly alleged that she asked him to wear a condom, but he allegedly refused as he was “clean” from any STDs.
During an alleged incident in early 2005, Penly claims she told Carter she didn’t want to have sex after arriving at his residence. Carter then allegedly responded by telling her the only reason she was there was to have sex with him.
The situation allegedly escalated, with Penly claiming he forcefully bent her over his bed and penetrated her vaginally despite saying “no” several times.
Penly, who said she never had unprotected sex prior to meeting the singer, claimed he did not wear a condom during the alleged assault—which he allegedly asked her to keep a secret, suggesting no one would believe her.
Carter allegedly apologized to Penly months later and asked to see her again.
Further into the complaint, Penly claimed to have met Carter again in Los Angeles before he led her into his bedroom. Despite telling him she did not want to have sex, the woman alleged he forcefully penetrated her and ignored her requests to stop.
The lawsuit sees Penly claiming Carter infected her with various STDs, including chlamydia, gonorrhea, and HPV. She also claims to have been diagnosed with cervical cancer as a result of her HPV infection, which later led her to undergo cancer treatments and surgery.
Penly is suing Carter for sexual assault, intentional infliction of emotional distress, negligent infliction of emotional distress and is seeking an unspecified amount of damages.
The singer denied the allegations in a statement made through his attorneys, Liane K. Wakayama and Dale Hayes, Jr.
"This is just more of the same nonsense from the gang of conspirators and their lawyers who continue to abuse the justice system to try to ruin Nick Carter,” Wakayama and Hayes, Jr. told TMZ. “It's drawn from the same predictable playbook – lie in wait for decades until Mr. Carter is celebrating a professional milestone, then hide behind litigation privilege to make utterly false claims in an attempt to inflict maximum damage on Nick and his family."
The attorneys are referring to the Backstreet Boys, who are recently celebrating the 25th anniversary of their 1999 album, Millennium.
The legal team also said Carter doesn’t recall meeting Penly nor having a sexual relationship with her before mentioning her “documented history of financial and legal trouble,” which includes filing for bankruptcy and being sued for fraud.
