Woman Slips on Prosciutto, Sues Italian Supermarket Eataly for $50,000 in Damages

The incident took place last October at the chain's Prudential Center location in Boston.

Italian food market Eataly is facing a lawsuit from a customer who allegedly slipped on a piece of prosciutto while eating at the restaurant last fall.

NBC Boston reports the incident took place in October 2022 at Eataly Boston, which opened in 2016 at the Prudential Center food hall.

Alice Cohen of Gilford, New Hampshire filed a lawsuit in the Suffolk County Superior Court in Massachusetts on Friday, claiming she suffered a broken ankle after slipping on a piece of prosciutto on Eataly Boston’s floor.

"As Plaintiff Alice Cohen approached the area she slipped and fell on a piece of prosciutto on the floor injuring her left ankle resulting in fracture,” the lawsuit read. Cohen accuses Eataly of failing to "ensure that the floor was free from unnecessarily dangerous conditions."

"As a direct, proximate and foreseeable result of the negligence of Eataly Boston, Alice Cohen sustained bodily injuries, a loss of enjoyment of life, pain and suffering and incurred necessary medical expenses for medical care and attention," the complaint stated.

Cohen is suing the restaurant for negligence and loss of consortium, while seeking $50,000 in damages as well as a jury trial, as she says she's spent $7,500 in medical bills in the wake of her injury.
